SKKU-PSDL | Global Lecture Exchange Series

Transnational dialogue and collaboration are as important today as ever. My visit to 성균관대학교(Sungkyunkwan University) Law School last October laid the foundation for a new series of virtual lectures with Penn State Dickinson Law, with each law school alternating as host.
I enjoyed speaking with faculty and students at what, as I learned, is East Asia’s oldest university about the latest global AI and IP developments, including South Korea’s recent AI legislation. I look forward to hosting Sungkyunkwan Law Professor Patricia A. Goedde for her lecture to our community on “Institutional Pathways for Public Interest Lawyering in South Korea” on April 2.

[President Klaus Grabinski: Leadership, Law, and the Future of the Unified Patent Court]

Delighted to sit down with President Klaus Grabinski, who serves as President of the Court of Appeal and Chairperson of the Presidium of the Unified Patent Court (UPC). His perspectives on resilience, adaptability, and leadership—both in law and life—were inspiring.

President Grabinski’s distinguished career spans decades in the judiciary, including his tenure on the German Federal Court of Justice’s 10th Civil Division, where he shaped patent litigation jurisprudence. His journey from law student to leading one of Europe’s most significant judicial institutions is a testament to dedication, adaptability, and a deep commitment to justice.

In our conversation, he shared his thoughts on life and leadership, from his early years and passion for mountain climbing to navigating the complexities of working in a multicultural court. We also delved into decision-making at the UPC, the role of English and German judgments, and AI and SEP regulation in the EU.

I spoke about the jurisprudential importance of dissents presented in my 2017 law review article “I Dissent: The Federal Circuit’s ‘Great Dissenter,” Her Influence on the Patent Dialogue, and Why It Matters,” published in the Vanderbilt Journal of Entertainment & Technology Law.

George Mason Law Review 28th Annual Antitrust Symposium | The Clash of AI Competition and Copyright Law

Delighted to speak at the George Mason Law Review’s 28th Annual Antitrust Symposium, “Antitrust Cornucopia: AI, Ad Tech, Content Moderation, & What’s Next?” on “The Clash of AI Competition and Copyright Law.”

Ably moderated by Ai Deng, PhD, Mark Gray (OpenAI), Elena Ponte (Federal Trade Commission) Kristian Stout (International Center for Law & Economics) and I covered key antitrust and intellectual property challenges related to AI, including market power, data access, and fair use. We spoke about the historical conflicts between IP and antitrust, the role of AI data licensing and open-source AI, and proposed policy and legal approaches to balance innovation, competition, and the rights of copyright owners.

The symposium also addressed the U.S. Department of Justice’s Ad Tech antitrust case against Google and its implications for the ad tech ecosystem and competition; evolving content moderation practices, focusing on Section 230 and the EU’s Digital Services Act, and what the Trump administration should prioritize at the antitrust agencies.

Professor Bachar engaged our faculty, staff, and students in a lively and thought-provoking discussion on the issues explored in her forthcoming article, “Coercive Settlements,” which will appear in The George Washington Law Review.

A proud Northeast Corridor+ Faculty Scholar Exchange Program member, Penn State Dickinson Law joined the program a couple of years ago through Dean Danielle Conway’s leadership, and it is an important research initiative.
