Fordham Center on Law and Information Policy | Decennial Fellows Roundtable

Delighted to join Fordham University School of Law’s Decennial Fellows for their Spring 2025 Roundtable Series. The Decennial Fellows Program, hosted by Fordham’s Center on Law and Information Policy (CLIP) at Fordham Law School, brings together top law students focusing on technology, privacy, cybersecurity, and AI. Thank you to Andrea Flink for inviting me!

At the request of several Fellows, I addressed issues such as how global jurisdictions approach AI regulation, what it means to be “original” in the age of machine creativity, and how law can re-engage with creators through compensation, contract, and tort frameworks. I outlined a comparative framework for understanding regulatory approaches across the U.S. (market-driven), EU (rights-driven), and Asia (growth-driven). I emphasized the need to “reskill, remunerate, and re-engage” stakeholders impacted by AI. I also discussed developments such as Nightshade, the use of synthetic data, NIL (name, image, likeness) issues, and legal responses to ingestion-based infringement.

The Debrief | AI Chatbots Display Humanlike Biases, Raising Concerns Over Their Decision-Making Reliability

In my interview with The Debrief, I weighed in on groundbreaking research that reveals how popular AI chatbots like ChatGPT increasingly mimic human reasoning and bias.

My main point was that ethical oversight isn’t just about technical robustness — it’s about legitimacy and trust. AI is not just code; it’s a norm-generating system. It shapes behavior and decisions, particularly in courts or health systems. I suggested ethical guidelines should integrate legal concepts like due process, equal protection, and the overall promotion of transparency, including independent regulatory bodies with teeth and public disclosure of model behavior in high-impact domains.

Conversation Op-ed | What would happen if Section 230 went away?

In a recent op-ed in The Conversation U.S., I examined the far-reaching consequences of repealing Section 230 of the Communications Decency Act, the foundational law often credited with building the modern internet.

From the chilling effect on free expression to the potential unraveling of content moderation practices, his analysis illuminates how platforms like Reddit, Inc., Yelp, and TikTok — and the users who rely on them — would be affected in a post-230 landscape.

WalletHub | Credit Card Fraud Guide

WalletHub recently interviewed me for their article “Credit Card Fraud Guide.”

I noted that while banks have made strides in fraud detection through machine learning and real-time monitoring, criminals are keeping pace, exploiting everything from phishing schemes to data breaches. I also discussed synthetic identity fraud, which involves criminals combining real and fabricated personal information—such as a legitimate Social Security number with a false name—to create entirely new identities.

Celebrating | Jenni Evans

Jenni Evans was a giant in meteorology and interdisciplinary research. When I joined Penn State, she helped appoint me as a co-hire at the Penn State Institute for Computational and Data Sciences (ICDS). It was—and remains—an important appointment that enriched my experience, as I got to mix with and learn from colleagues and friends across the university.

Jenni was generous with her time and invited me to join her in expanding ICDS’s global footprint—one conversation and one event at a time. When she retired last year, we at ICDS, her husband Bruce, and senior vice president for research Andrew Read wished her well.

As the Penn State community gathers tomorrow to celebrate her life and towering achievements, I am blessed to have known her personally. She was as remarkable as she was inspiring. My “Profiles in Leadership” interview with her in 2024 may have been the last one she gave. In it, she reflects on her life, work, and more. With her passing, I hope those seeking a trace of her vivacious personality or penetrating insights will find it there.

Sungkyunkwan University Law Professor Patricia Goedde | Institutional Pathways for Public Interest Lawyering in South Korea

Delighted 성균관대학교(Sungkyunkwan University) Law Professor Patricia A. Goedde spoke at 2nd 성균관대학교(Sungkyunkwan University)-Penn State Dickinson Law lecture this week. The virtual lecture was open to Penn State Dickinson Law communities at both locations and the Sungkyunkwan community and a good number joined us.

Dean Danielle Conway welcomed Professor Goedde and noted the significance of Sungkyunkwan’s name – “an institute to make a harmonious society.”

Professor Goedde delivered a thought-provoking lecture titled “Institutional Pathways for Public Interest Lawyering in South Korea.” Her expertise and commitment to human rights and public interest advocacy were evident throughout her talk. It was especially meaningful to hear her thoughts on the evolving institutional landscape—from public interest law firms to law firm pro bono centers—and the role of legal education in supporting this vital work. The continuous stream of questions and comments spoke volumes about the interest Professor Goedde’s talk generated.
