Blog[Strengthening IP Connections in Germany] My recent visit to Germany was a rewarding opportunity to deepen ties with leading practitioners, judges, and other stakeholders shaping the IP landscape in Europe and beyond. It was a pleasure to exchange ideas with colleagues, including those from NORDEMANN (Jan Bernd Nordemann, Michael C. Maier, LL.M., Dr. Andreas Lubberger), ARNOLD RUESS (Peter Ruess, Cordula Schumacher), Freshfields (Wolrad Prinz zu Waldeck und Pyrmont, Dr. Tobias Timmann), HOYNG ROKH MONEGIER (Tobias Hahn, Jenny Marlen Bülthoff), BOEHMERT & BOEHMERT (Heinz Goddar, Ute Kilger, Melanie Müller), UPC (Tobias Pichlmaier, Dr. Matthias Zigann), the Munich Regional Court (Oliver Schön, Katalin Tözsér, Florian Schweyer), and Maiwald Intellectual Property(Dr. Eva Susanne Ehlich, Alexander Mueller). Our discussions ranged from ways to enrich conference panels and roundtables, balancing speaker diversity, depth of discussion, and global reach, to potential venues, and topic proposals spanning FRAND, ADR, trade secrets, biologics, AI/data regulation, and comparative perspectives between German courts and the UPC. I was encouraged by the enthusiasm for bringing in new voices, including judges and practitioners from the U.S., Asia, and Latin America, to keep dialogue fresh and globally relevant. Blog[SG60: “Intellectual Property and Technology in the 21st Century” conference at NUS Law.] I had the privilege of speaking at the plenary session of Intellectual Property and Technology in the 21st Century, an outstanding conference co-hosted with Columbia Law School, Faculty of Law, University of Oxford, and Tsinghua University School of Law. Kudos to Professor David Tan and his team for bringing together such a stellar group of scholars and practitioners. My talk explored why the U.S.’s patchwork of privacy, publicity, and copyright laws is not a bug, but a feature in governing generative AI, and why a narrowly tailored federal “data right” could fill critical protection gaps while keeping innovation alive. A standout moment was the keynote by World Intellectual Property Organization – WIPO Director General Daren Tang, who reminded us that innovation must remain human-centred in the age of generative AI. Delighted to meet with Cyrielle Ouedraogo (Carlisle) and Michael Wright (University Park), who successfully secured internships with GEN Law Firm at their Beijing office. Many thanks to founding partner Jing He and his partner in charge of internships, Lily Xue Dong, for opening up this invaluable opportunity, previously exclusive to Notre Dame law students, to our community at Penn State. Thanks also to my colleague Tom Lee for working with stakeholders, both internal and external, to realize what may have seemed an improbable achievement to some, particularly given the fractured world we live in. There is yet hope that collaboration can exist amidst contestation. As one initiative takes off in Asia, Tom and I are already working with partners in Europe to expand new opportunities for our students there.

Blog[Speaking on AI, Law & Global Media at EXNW 2025] I had the honor of speaking at EXNW 2025 in Vancouver, Canada, in a featured session titled “AI, Law, and the Future of Global Film, TV and Media” alongside Canadian MP Taleeb Noormohamed, Parliamentary Secretary for Artificial Intelligence and Digital Innovation. Our session examined the legal, ethical, and policy challenges presented by generative AI in the media, encompassing issues of authorship and copyright, cultural sovereignty, and the governance of deepfakes. These are pressing issues with transnational implications, and it was a privilege to contribute to the ongoing dialogue that is shaping the future of law, technology, and the creative industries. The conversation drew on my broader scholarship in AI regulation and my commitment to public engagement on emerging technologies. I’m especially grateful to Barbara Lee, Hanna Cho, and the EXNW team. Blog[Just Published: Banana Republic: Copyright Law and the Extractive Logic of Generative AI] I explore the intersection of art, copyright, and AI in my latest article, “Banana Republic: Copyright Law and the Extractive Logic of Generative AI,” published in the Journal of Intellectual Property Law & Practice (Oxford University Press). Using #MaurizioCattelan’s #Comedian and the figures of the fruit seller, the buyer, and the artist as metaphors, the article interrogates who is valued, who is erased, and who reaps the rewards. These figures expose how value, labour, and authorship are dislocated and reassembled in ways that challenge the assumptions underpinning copyright law and cultural production.
