IPWatchdog: What Mattered in 2019
IPWatchdog’s Dec. 31 post carried reflections by industry insiders on the biggest IP moments in 2019.
I identified three moments:
1) AI taking centerstage, and a call for stakeholders need to come together and help courts and governments forge a path forward that is pragmatic, enlightened, and politically wearable;
2) the FTC-Qualcomm case and its potential impact on the IP-antitrust, which takes place against a broader backdrop where long-cherished Chicago School concepts are challenged by a growing distrust of digital platforms and their monopoly power; and
3) the rise of forum shopping in FRAND litigation and how it might be the proverbial canary in the coalmine. What national courts say on this issue will tell us whether the fragmentation of the political world order has also seeped into IP dispute resolution.
